Terms of Use

1. About these terms

These terms govern your use of materiam.com and of the MATERIAM connector for AI assistants (https://materiam.com/mcp). The service is run by MATERIAM, S.A.P.I. de C.V. and, for customers in the United States, its affiliate Amatix, Inc. ("MATERIAM", "we"). By using the site or the connector you agree to these terms.

2. The service

MATERIAM quotes and manufactures custom metal parts: laser-cut and bent sheet metal, tubes, structural shapes and welded assemblies, with finishes, delivered in Mexico and the United States or picked up at our plant in Querétaro.

3. Quotes

• Quotes are free and need no account.
• Prices are calculated when you quote and can change with material costs; the price that applies is the one shown when you place your order.
• Prices exclude shipping, which is shown after a free sign-up.
• Prices for Mexico are in Mexican pesos, with IVA shown separately. Prices for the United States are in US dollars and include the US import duty, which we pay as importer of record.
• Each quote shows its lead time, and the delivery date is calculated for each order and shown before you pay. Delivery dates are estimates.

4. Accounts and orders

• An account is needed to order. Keep your account details accurate and your password private.
• Orders are placed and paid on materiam.com. Card payments are processed by Stripe.
• An order is confirmed when it is paid, or, for orders on agreed payment terms, when we start it.
• Once production starts, an order can't be cancelled. Write to us as soon as possible if you need a change.
• If parts arrive damaged or don't match your order, tell us within 7 days of delivery and we will review it with you.

5. Your designs

• You keep ownership of your files and designs.
• You give us permission to use them to quote, make and ship your parts and to operate the service.
• You confirm that you have the right to have the parts made.
• We treat your files as confidential, and a non-disclosure agreement is available on request.

6. AI assistants

• You may connect an AI assistant to MATERIAM through our connector. The assistant acts on your instructions, and you are responsible for what it sends on your behalf.
• Quotes produced through the connector are calculated the same way as on materiam.com.
• Orders are placed on materiam.com, not through the connector.
• Projects created through the connector are deleted after 7 days unless you open them in your MATERIAM account.
• We may limit uploads and requests to keep the service available for everyone.

7. Design checks are guidance

Our manufacturability checks, bending simulations and design findings help you prepare a part that can be made. They are not an engineering review of your design. You remain responsible for your design and for whether the part is fit for its purpose.

8. Acceptable use

• Use the site and the connector lawfully.
• Don't upload files you have no right to use, try to break or overload the service, or access projects that are not yours.
• We may decline any order.

9. Our site

The site, the software and the MATERIAM name and marks belong to MATERIAM. These terms don't give you rights to them beyond using the service.

10. Liability

To the extent the law allows, our liability for an order is limited to the price paid for that order, and we are not liable for indirect or consequential losses such as lost profits or production downtime.

11. Governing law

For customers in Mexico, these terms are governed by the laws of Mexico, and disputes go to the courts of Querétaro, Querétaro. For customers in the United States served by Amatix, Inc., they are governed by the laws of the State of Texas, and disputes go to the courts of Tarrant County, Texas.

12. Changes

We may update these terms and will post changes on this page with a new date. Orders already placed keep the terms that applied when they were placed.
